Collector directed to order suspension of BDO for not bringing files to court

Case relates to 8-year-old proceedings against panchayat union employee

The Madras High Court on Friday directed Tiruvallur Collector to suspend from service a Block Development Officer for failing to bring records that were called for by the court in connection with an inordinate delay of eight years in completing disciplinary proceedings initiated against a panchayat union employee.

Justice S.M. Subramaniam ordered that BDO S.G. Krishnan should also be subjected to disciplinary proceedings under the Tamil Nadu Civil Services (Discipline and Appeal) Rules of 1955 and some other responsible officer should be deputed to attend the court proceedings on July 30 along with the relevant files.

The judge passed the interim orders on a writ petition filed by G. Jayaprakash of Uthukottai Taluk. The petitioner, a suspended employee of Poondi Panchayat Union, wanted the court to quash the disciplinary proceedings pending against him for eight long years.

In order to find out the reason for the delay, the judge on Wednesday passed an order directing the BDO to be present in the court on Friday along with the relevant files. Though Government Advocate D. Raghu claimed to have communicated the order promptly, the BDO did not bring the records. Irked over his conduct, the judge said: “The BDO has not understood the seriousness of the judicial proceedings. He has committed dereliction of duty and exhibited negligence by not bringing the files and not giving proper instructions to the learned Government Advocate for defending the writ petition on behalf of the State.
