Community certificate of other states not valid for med seat in Tamil Nadu

Tamil Nadu to consider her application for MBBS admission under the reserved category for scheduled tribes.

Chennai: Madras High Court held that Community Certificate issued by other states will not be valid to get a seat in medical course in Tamil Nadu.

Justice S Vaidyanathan, before whom a petition filed by a student S Geetha came up for hearing, said that “In my view, the petitioner would not be entitled to get any relief in this writ petition, since the petitioner has produced the community certificate issued by Andhra Pradesh and seeking relief to consider her candidature under the reserved category.”

The petitioner, who is holding a scheduled tribe community certificate issued by Andhra Pradesh, has sought the court to direct the selection committee, Directorate of Medical Education, Tamil Nadu to consider her application for MBBS admission under the reserved category for scheduled tribes.

The judge said, the Supreme Court in Mari Chandra case had clarified that a scheduled caste/tribe person who has migrated from the state of origin to some other state for the purpose of seeking education, or employment will be deemed to be a scheduled caste/tribe of the state of his origin and will be entitled to derive benefits from the state of origin and not from the state to which they have migrated.

The judge said in the present case, de-hors the question of migration, it is an admitted fact that the petitioner had obtained community certificate from Andhra Pradesh and in view of the prospectus for MBBS admission, the petitioner will not be entitled to any relief and her candidature can be considered only under the open category and not under the reserved category.
