Doctor told to compensate woman for medical negligence

The Madurai District Consumer Forum has directed a city-based doctor to pay a compensation of Rs. 3 lakh to the mother of a boy who died in 2007 as a result of medical negligence.
The forum, comprising president V. Balasundarakumar and members C. Packialakshmi and M. Maraikamalai, allowed the petition filed by Tamilarasi, mother of the boy, Madhan Kumar, and directed Dr.S.Swaminathan to pay the compensation to the victim’s family.
The complainant is said to to have taken her son for medical check-up after the boy complained of severe pain due to hernia. The doctor, after examining the boy, said that an immediate surgery had to be performed. The doctor arranged for the operation at a hospital owned by him.
The surgery went on for over two hours, said the complainant. The doctor said that though the operation for hernia was successful, her son was suffering from suffocation and needed to be shifted to another hospital for further treatment. The boy was transferred to Meenakshi Mission Hospital where he was declared dead due to suffocation.
The complainant contended that her son’s death was a result of the doctor’s negligence. The first hospital also did not possess necessary equipment and the boy was treated without ventilator support, she said.
The complainant said that when she approached the doctor seeking particulars of her son’s reports, he refused to hand them over. Even after a complaint was lodged with the police, he only furnished the medical bills, she said. As the doctor failed to respond to a legal notice, she sought compensation for putting her through mental agony.
