Compensate guest, forum tells resort

The petitioner, M. Murugaiah of Anna Nagar, submitted that the Odour Club has been running a resort at Pattipulam village, ECR.

The resort management published several advertisements assuring that the resort was suitable for fun-filled stay, especially during weekends.

Chennai: The District Consumer Dispute Redressal Forum, Chennai (South) directed a resort in East Coast Road to pay a compensation of Rs 26,000 to person for dashing his dream of celebrating New Year in a fun-filled manner at the resort two years ago.

The petitioner, M. Murugaiah of Anna Nagar, submitted that the Odour Club has been running a resort at Pattipulam village, ECR. The resort management published several advertisements assuring that the resort was suitable for fun-filled stay, especially during weekends.

The management also assured of offering various facilities for entertainment, including accommodation in hotel, indoor, outdoor games, various social and cultural activities.

Hoping for a fulfilling celebration during New Year eve in 2016, he paid `18,000 towards membership fee in December 2015. With great expectations he reached the resort along with his family members on January 1, 2016 to welcome New Year in a pleasant atmosphere.

However, to his shock and surprise the resort was not suitable for having fun and pleasure. Their stay was also spoiled.

The family members were deeply saddened and disappointed. Hence, he sent letters to management of Odour Club, Manager, Vadapalani on February 22, 2016 and on April 27, 2016 requesting to refund Rs 18,000.

As there was no response, he filed the petition seeking direction to the management to refund the amount he paid towards membership fee and compensation for causing him mental agony and harassment. Despite of receipt of notice the manager of Odour Club had not appeared before the forum.

The bench comprising president M. Mony and member K. Amala said considering the facts and circumstances “the forum is of the considered view that the management of the Odour Club shall refund `18,000 and also to pay Murugaiah a compensation of `8,000 for causing mental agony.”
