Bhopal gang rape: Life sentence to accused

Bhopal: The court of additional district and sessions judge Savita Dubey on Saturday sentenced all the four accused in the Habibganj gang rape case to imprisonment for life till death. She also fined the accused ₹60,000 under various sections of the IPC, which would be utilised for rehabilitation of the victim.
In her 55-page verdict, the judge praised the rape survivor for bravely facing the circumstances despite the fact that police didn’t even register her FIR. “Despite this, the rape survivor and her parents continued their fight that the guilty have been brought to book”, said the judge.
The court said that evidence produced in the case makes it clear that the four accused had gang-raped her. Such an act is not only heinous in nature, but an incident like this at a tender age could lead to psychological disorders in the survivor. It also creates fear among parents, which hampers growth prospects of the girl child. The psychological and social repercussions of an act like this on the survivor and her family leaves no room for any generosity towards the accused”, the judge said.
The accused Golu Bihari, Amar, alias Guntu, Rajesh, alias Raju and Ramesh Mehra had been charged under Section 341, 354, 342, 323, 376 (d), 376 -2 (m) (n) and 307 for illegal confinement, gang rape and attempt to murder. The court sentenced the accused to life imprisonment under provisions contained in section 376 (d) and 376-2(m),(n).
Forensic evidence sealed the case
Forensic experts played a vital role in sealing the gang rape case for the prosecution. Prosecution lawyers said that DNA finger printing of the accused proved that they have had bodily contact with the complainant, soil testing proved that soil found on their body or stuck in their footwear was the same as found at the site where the incident had taken place and diatom test proved that water which went into their body during the act was the same as that of the nullah by the side of which the rape had taken place proved beyond doubt that they were guilty.
