Plea to quash Medical Council of India notification on recruitment of Senior Resident

CHENNAI: A PIL petition has been filed in the Madras High Court to quash a notification dated June 5, 2017, of the Medical Council of India (MCI), making MD/MS degree-holders also eligible for the Senior Resident post in the broad specialty as well as super-specialty categories.The First Bench of Chief Justice Indira Banerjee and Justice Abdul Quddhose, before which the PIL from Dr G Jaysia of Kalappa Naicken Patti village in Namakkal came up for hearing on Monday, ordered notice returnable by Friday (April 13).

According to the petitioner, who has completed the diploma course in Medical Radiology Diagnosis and is presently working as Senior Resident in Radio Diagnosis in the Government Mohan Kumaramangalam Medical College and Hospital, the MCI notification, making the MS and MD degree-holders also eligible for promotion as Senior Residents, is illegal and totally ultra vires of the Constitution.

It would completely wipe out the promotional opportunities of doctors holding diplomas to become Senior Residents. Various promotional avenues are open for the MS/MD degree-holders, whereas for the diploma-holders the only avenue is the post of Senior Resident, the petitioner said.
