Website to pay ₹14K for failure to publish ad

Chennai: District Consumer Redressal Forum, Chennai (south) has ordered popular classifieds website Sulekha.com to pay a compensation of ₹14,000 to a customer for not publishing an advertisement despite collecting the tariff amount for it.
Complainants Vasumathi and Dineshkumar had approached the forum seeking action under section 12 of the Consumer Protection Act after the classifieds website failed to advertise their firm Mobile Beauty Parlour.
The branch manager of Sulekha.com had reportedly assured that an advertisement under a special category ‘Mobile Beauty Parlour’ would be placed in the yellow pages within a week, after which they paid ₹4,412 to the website for it.
According to their petition, they requested the website to publish their advertisement and provided the content for the same as: ‘Pampering yourself has never been so easy. We are just a call away. Enjoy a relaxing day at your home and rejuvenate your body, mind and soul. We at Mobile Beauty Parlour offer wide variety of services from hair massage to royal pedicure.’ The complainants’ contention was that despite the promise, the website failed to create a new category and did not publish the ad within a week, as agreed upon. The complaints said that this caused them mental agony and issued a notice to them in September 2012. Since there was no response, they moved the forum seeking a compensation.
The bench comprising president M Mony, members K Amala and Dr T Paul Rajasekaran said that the forum is of the view that Sulekha.com committed negligence and ordered it to refund ₹4,412 with an interest sum calculated at 9% per annum along with a compensation of ₹10,000 for causing mental agony to its customers.
