Court allows Lankan Tamils to seek Indian citizenship

The Madurai bench of the Madras high court has permitted 65 Sri Lankan Tamils who are seeking Indian citizenship to submit a fresh representation to the concerned district collectors and forward the same to the central government without any delay.
In their petition filed in 2009, the petitioners had stated that their forefathers hailed from Tamil Nadu. They fled to India when Sri Lanka witnessed a genocidal and brutal ethnic strife in 1983 and were kept in Kottapottu camp in Trichy district. They urged not to be treated as refugees and instead treated as Indian repatriates. Both the central and state governments submitted that the petitioners arrived in India without proper documents and are illegal migrants, not eligible for Indian citizenship.
Justice G R Swaminathan, who heard the case, said, “A person who is running for his life cannot obviously be expected to wait for a visa.” The judge directed that once the central government receives the petitioners’ applications, it shall pass appropriate orders within a period of 16 weeks considering the unique situation.
