Legislation was lying dormant for more than two decades
The State government on Wednesday informed the Madras High Court of having finally notified the statutory rules under the Tamil Nadu Clinical Establishments (Regulation) Act of 1997 and thereby having brought the 20-year-old dormant law into force with effect from June 1 this year.
Justice N. Kirubakaran appreciated the State government for having given effect to the Act two decades since it was enacted and two years after he began persistently persuading the government to enforce the law. He expressed happiness over a gazette notification having been published at last.
The judge had begun insisting on bringing the law into force after the death of Santosh Kumar, a final year MBBS student, within two days after he underwent a hair transplant procedure at a clinic in Nungambakkam here in May 2016. The death had forced the corporation to lock and seal the clinic.
Immediately, the clinic filed a writ petition for desealing, and the judge broadened the scope of the case and began issuing a series of directions to the government to make sure that all clinical establishments in the State get registered with the State government and their functioning was monitored by regulatory bodies.
He found that a law had been enacted way back in 1997 itself for the establishment of district level as well as State-level advisory committees for monitoring clinical establishments and for prescribing the duties and responsibilities of such establishments. However, it had not come into force for want of framing of rules.
After consistent follow up, the judge made sure that the government brought the law into force after making certain amendments.
