Will take action if univs don't follow norms, says UGC

Chennai: Tamil Nadu's State universities that have not yet adopted the University Grants Commission (UGC) Regulations for appointment of vice-chancellors and other factors could face action, as the UGC told the Madras high court on Monday it had decided to write to the Centre on the issue.

Additional solicitor general of India G Rajagopalan, representing UGC, told the first bench of Chief Justice Sanjay Kishan Kaul and Justice Pushpa Sathyanarayana that UGC will 'very soon' take action in the case once the Centre replies to its communique.

A submission to this effect was made when a PIL filed by ChangeIndia director A Narayanan to quash a May 2015 advertisement calling for applications for appointment of vice-chancellors for the state universities. Pointing out that the state universities had not adopted UGC Regulations, it would be impermissible to allow them to go ahead and adopt a different procedure for selection of vice-chancellors in violation of UGC regulations.

The first bench reserved its orders on Monday, but not without mildly rapping the UGC for its inaction. Pointing out that advocate general of Tamil Nadu A L Somayaji had repeatedly said adopting UGC Regulations by state universities was 'under consideration,' the judge said it is obvious now that no decision would be taken any time soon. But what action has UGC taken, it asked the additional solicitor general who was assisted by UGC's standing counsel Gopinathan.

Somayaji, however, said the Supreme Court had categorically addressed all the issues raised by the PIL by in the Kalyani Mathivanan case, and that unless the universities adopt the UGC Regulations they would not be bound by the latter while selecting vice-chancellors. "Merely because the Regulations are not adopted, there would not be any vacuum. The Act of the university concerned would operate during the period," he said.

Counsel for PIL-petitioner, however, said that in the case of Madurai Kamaraj University the UGC Regulations had been adopted only for the purpose of payscale, including that of vice-chancellor. Such partial adopting of regulations is impermissible, he said.
