High Court reserves order in DME case

Dr. Revwathy Kailairajan, who is retiring on Feb 28, had filed contempt plea

The Madurai Bench of the Madras High Court on Monday reserved its orders in the contempt case relating to the appointment of Director of Medical Education.

A division bench of Justices T.S. Sivagnanam and R. Tharani, which took cognisance of reports filed by the State on the DME panel, reserved its orders. The court had earlier called for original records of the panel and the selection process. It was told that the appointments were made in a fair manner as per appointment rules.

Dr. Revwathy Kailairajan had filed the contempt petition, complaining that she was not considered for appointment as the DME and the government had failed to constitute a proper panel.

The State, in its counter, maintained that Dr. Edwin Joe was eligible for the post as he was appointed as Dean before Dr. Revwathy Kailairajan. The State said the two key eligibility criteria of the candidate – possessing a postgraduate medical degree and having at least one year left for retirement – were met by Dr. Joe.

Dr. Revwathy Kailairajan moved the High Court in 2017 challenging the appointment of Dr. Joe. A single-judge bench had ordered the appointment of Dr. Revwathy as the DME and quashed the appointment of Dr. Joe. The court had observed that Dr. Revwathy was senior to Dr. Joe in the profession.

However, both the State government and Dr. Joe preferred appeals against the order and status quo was ordered by a vacation bench.

A division bench, which heard the appeals, set aside the order of the single bench and directed that a fresh selection process be held considering the cases of Dr. Revwathy, Dr. Joe and Dr. Meenakshi Sundaram.


Dr. Revwathy is set to retire as Dean, Government Medical College and Hospital, Karur, on February 28.
