A small group of lawyers acting like a mafia: HC

CHENNAI: In one of the most stinging rebukes against a few of lawyers resorting to strong-arm tactics to take possession of properties and committing Madras high court has said they were behaving like a mafia by taking law into their own hands and using their lawyer status as a shield.

"These people in black and white dress act like mafia and they are stated to be indulging in kidnapping, extortion and other heinous crimes, taking advantage of their alleged status as lawyers, as the police is also afraid of taking action against them fearing adverse consequences. It is very unfortunate that it has come to such a level that even matters involving heavy stock and crores of rupees are not dealt with either by advocates who are having expertise in civil law or the designated senior counsel, but they are being dealt only by the advocates who take those disputes as packages," rued Justice N Kirubakaran.

The judge was passing orders on a dispute revolving around Annai Medical College at Sriperumbudur. There has been a raging civil dispute between two sets of trustees of the college, and both sides apparently engaged groups of lawyers to take possession of the college premises, by interpreting court orders to their convenience. Inspite of revocation of no-objection certificate by the state government as early as in 2011, the college was allowed to admit students in 2016-17. However, owing to grave deficiencies, it has now been restrained from admitting students for two years. Amidst allegations that the attached hospital had become defunct and almost every academic facility shut down, 136 students admitted under state quota as well as NEET last year are staring at uncertain future. Now, their senior counsel A Sirajudeen told Justice N Kirubakaran that since there was an inbuilt clause in the state government NOC, the students should be transferred and accommodated in a government medical college.

It was during the hearing that photographs showing men wearing black and white entering the college campus, badmouthing officials and occupying the premises were shown to the judge. Lamenting the degeneration of standard of legal profession, caused by a small group of lawyers, Justice Kirubakaran said: "The so-called lawyer groups act as extra judicial authorities to settle civil disputes using force with the aid of communal, religious and political groups."
