III-year student cannot seek loan for fee paid in second year: HC

  The Madras High Court Bench here has concurred with a nationalised bank that education loan cannot be granted to reimburse fee paid by a student before progressing from one academic year to the next. The court agreed with the bank that a student in the third year of a course could not seek loan for the first or second year of the course.

Justice V. Parthiban dismissed a writ petition filed by a Kanniyakumari based homoeopath pursuing her third year post graduate degree in psychiatry at a private medical college in Salem seeking education loan for the second as well as third year of her course after recording the submission of Indian Overseas Bank that the loan could be offered only for third year.


Though the petitioner had sought for a direction to the bank to consider her representation for sanctioning a loan amount of Rs. 3.49 lakh towards second and third year tuition fee, the bank told the court that she was eligible for Rs. 1.59 lakh to meet out the expenses for the third year of study alone since she had already completed the second year of the course.

After extracting the contents of the bank’s counter affidavit, the judge said: “It is clearly mentioned that since the petitioner had successfully completed two years, the question of granting loan for the second year does not arise. In view of the categorical statement made by the respondents/bank, I do not think that the prayer in the writ petition can be granted.”
