III-year student cannot seek loan for fee paid in second year: HC
The Madras High Court Bench here has concurred with a nationalised bank that education loan cannot be granted to reimburse fee paid by a student before progressing from one academic year to the next. The court agreed with the bank that a student in the third year of a course could not seek loan for the first or second year of the course.Justice V. Parthiban dismissed a writ petition filed by a Kanniyakumari based homoeopath pursuing her third year post graduate degree in psychiatry at a private medical college in Salem seeking education loan for the second as well as third year of her course after recording the submission of Indian Overseas Bank that the loan could be offered only for third year.
After extracting the contents of the bank’s counter affidavit, the judge said: “It is clearly mentioned that since the petitioner had successfully completed two years, the question of granting loan for the second year does not arise. In view of the categorical statement made by the respondents/bank, I do not think that the prayer in the writ petition can be granted.”
