Lawyer moves HC against FASTag

Chennai: A lawyer has approached the Madras high court to stall the decision to make FASTag mandatory in toll plazas on the ground that it violated RBI mandate.

As per RBI guidelines, additional factor of authentication such as confirming a financial transaction by way of entering one time password (OTP) is mandatory for online payment through prepaid wallets. But NHAI has blatantly violated such norm and has given access to FASTag to automatically deduct money from users’ accounts, advocate Kabilan Manoharan said. Kabilan further alleged that absence of such additional authentication has led to deduction of Rs 55 from his FASTag wallet for having crossed a toll plaza at Sriperumbudur around 1am on November 25. On that particular day and time, his car was parked in his residence at T Nagar and he was fast asleep, he claimed.

According to the petitioner, he had actually travelled on the Chennai-Bengaluru national highway on November 23. He crossed the Nemili toll plaza near Sriperumbudur and Chennasamudram toll plaza near Wallajahpet on that day between 9am and 10.35pm after paying the toll in cash for the return journey as well. After crossing those two toll plazas, he purchased FASTag from Airtel payments bank counter at Chennasamudram. Thereafter, he crossed the Pallikonda and Vaniyambadi toll plazas using the FASTag radio frequency identification sticker stuck on the windshield. He returned to Chennai the same evening and crossed the first two toll plazas, on his way back, using FASTag and utilised the physical return toll receipts at the other two plazas. However, at 1.13am on November 25, he received a text on his cellphone on deduction of Rs 55 from his wallet for having crossed Sriperumbudur toll plaza.
