The High Court of Karnataka on Tuesday permitted six deemed-to-be universities to issue calendar of events for admission and to conduct independent entrance tests to select candidates for admission to professional courses offered by them. A vacation Division Bench comprising Justice Anand Byrareddy and Justice P.S. Dinesh Kumar passed the interim order on petitions filed by Yenepoya University, Mangaluru, and five other deemed-to-be universities questioning some provisions of the Karnataka Professional Educational institution (Regulations of admission and Determination of Fee) (Amendment) Act, 2015.
The provisions of the new Act treats the deemed-to-be universities under the University Grants Commission Act like any private professional colleges, prescribes methods for selection and admissions, and imposes condition that 25 per cent of their total intake should be reserved for the government quota.
A provision in the new Act had prevented them from holding independent entrance tests.
The petitioner-universities have contended that these provisions in the Act are not only unconstitutional, but also contrary to the verdicts of the apex court.
