Karnataka HC rejects petition challenging dismissal of postal employee

BENGALURU: The Karnataka high court has rejected a petition filed by an ex-Gramin Dak Sevak (GDS) working with the Department of Posts, challenging his dismissal from service on November 14, 2014 on charges of failure to pay/disburse the amount on maturity to the account holders.

"The petitioner has misappropriated the funds of the villagers who trust the post office and invest their small savings with the post office. Therefore, the disciplinary authority as well as the Central Administrative Tribunal (CAT)have held that such misconduct is not condonable" a division bench headed by Justice H G Ramesh has observed while dismissing the petition filed by one Shashidhara Shetty.

The Superintendent of Post Offices, Udupi division had issued a charge memo on May 31, 2013 against the petitioner with regards to five instances wherein the petitioner was accused of failing to account as well as deposit the entire amount, (ranging from Rs 50 to Rs 3700 ), failure to pay/disburse the amount on maturity to the account holders.

The petitioner, who was working as GDS had claimed that he actually did not misappropriate the amount of the customers but paid it late and that except one, none of the other affected persons came forward to tender evidence against him.

He further contended that punishment of dismissal from service is disproportionate, arbitrary as well as discriminatory.

On the other hand, CAT, Bengaluru bench which dismissed his plea in the first instance, had said that late payment of customers deposit or the quantum of amount does not reduce the gravity of misconduct and the same leaves serious dent on functioning of the department.
