CHHAPRA: Patna high court on Thursday granted anticipatory bail to the vice chancellor (VC) of J P University (JPU), Chhapra, D K Gupta in alleged purchase of blank answer books worth several lakhs without following the standard procedures. Earlier, the vigilance court at Muzaffarpur had rejected his anticipatory bail petition.
It may be mentioned here that besides the VC, five more persons and an agency figure in this vigilance case. They include finance officer (FO) Sonelal Sahni, financial advisor (FA) Pyare Mohan Sahai, supplier of the answer books Chandrakala Universal Pvt.Ltd of Allahabad, Prof Anita, Prof S K Verma and Prof. A K Tiwari, the last three are members of adhoc purchase committee constituted by the VC. While the FO was nabbed by the vigilance on May 28 from his Patna residence, others are evading arrest and trying for anticipatory bail.
The high court, after hearing the counsel of the petitioner, observed, "The FIR only talks of abuse of power, if any, and alleged wrongful gain by not following the procedures established by the law. This is an application for bail in anticipation of arrest. In the manner in which this application is sought to be opposed by the informant is indicative of the fact that the informant is more interested in getting the petitioner arrested to humiliate him rather than seek justice."
"In facts and circumstances of the case, in the event of arrest or surrender within four weeks from Friday, the petitioner D K Gupta shall be released on bail on furnishing bail bonds of Rs10,000 with two sureties of like amount each to the satisfaction of learned special judge vigilance, North Bihar, Muzaffarpur," the HC said.
JPU registrar Prof R P Bablo said, "The informer in the case, Biswajeet Singh Chandel, had been pursuing two courses-Ph D in physics and B.Ed simultaneously which is against the University Act. The VC had cancelled both his admissions."
