College violates SC order, fined Rs 37 crore

LUCKNOW: Expressing serious displeasure on their taking admission in MBBS course in 2015 despite the Supreme Court's restraint order, the Lucknow Bench of the high court on Monday denied adjustment of students in any other medical college.

It directed Dr MC Saxena College of Medical Sciences to return Rs 25 lakh to each of the 150 students as damages, including fees. The court directed the college to deposit the total amount running to the tune of Rs 37.50 crore with the director general, medical education, within two months.

It asked the DG to distribute the amount among the 150 students after their verification. The court also asked the district magistrate to realize the amount from the college as land arrears in case it was not deposited within the stipulated period. HC has summoned the compliance report from the DG within three months.

Justice DK Arora passed the order on a petition by Dodia Narendra Dilipbhai and other students. The petitioners had sought a direction from the court that they should be allowed to be adjusted on vacant seats of other medical colleges and then be allowed to appear for first-year examination of MBBS.

The court found that the Medical Council of India had disapproved the college from taking admission on MBBS seats due to lack of requisite infrastructure but HC had on 24 September, 2015, permitted the college to take admission on certain conditions subject to further orders. The Supreme Court stayed this order on September 29 on MCI's petition and finally rejected the HC's September 24, 2015, order on March 10, 2016.
