The Supreme Court refused to permit any more time to AIADMK leader V K Sasikala, V N Sudhakaran and J Elavarasi to surrender before the Bengaluru trial court to undergo the remaining part of their four-year prison term in a disproportionate assets case.All three sought four weeks time to surrender in their hurriedly drafted applications on Wednesday , each running into four pages. Sasikala said she had to “make some personal arrangements before surrendering“, while Sudhakaran said he had to make arrangement to run his business as well as studies of his minor children apart from citing his spondylitis and severe back pain. Elavarasi said she was widowed in 1991and now suffered from uncontrolled diabetes.
All three said “sudden incarceration would cause irreparable“ injury to them. Senior advocate K T S Tulsi mentioned the applications before a bench headed by Justice P C Ghose and requested a hearing in the afternoon before the bench of Justices Ghose and Amitava Roy , which on Tuesday upheld the trial court judgment to send the three to jail for four years.
Tulsi said, “Whenever the apex court set aside acquittal of a person and restored conviction, it had always given the convict time to surrender.“ But Justice Ghose would have none of it. He said, “We do not intend to pass any more orders on any application. We have spoken our mind through the voluminous judgment delivered yesterday .“
He added, “We had directed the convicts to surrender immediately . We will pass no more orders. You understand the meaning of immediate, don't you Mr Tulsi?“ Finding Justice Ghose not amenable to any excuse, be it health, family or personal inconvenience, Tulsi beat a retreat knowing full well that there was no option for his client but to surrender.
In her application, Sasikala said, “The applicant has to make some personal arrangements before surrendering in terms of the SC order. Sudden incarceration of the applicant would cause irreparable injury and tremendous hardship to her and therefore she is seeking extension of time from surrendering.“ Sudhakaran was the most elaborate among the three in stating his difficulties.
“He is a businessman who has to manage the affairs of his business and therefore some time is required. He has one minor son and one daughter who are studying and therefore he needs some time to manage their studies and other needful things for their future. The applicant is also suffering from spondylitis and severe back pain,“ his application said.
